Reaching Corrective Action 2020 Remedy Construction Faster  

In last month's Focus on the Environment newsletter, we evaluated whether EPA would meet its RCRA Corrective Action goal for the 2020 Initiative – achieving remedy construction at 95 percent of the facilities on the 2020 baseline by the year 2020.  We concluded that at the 2010 pace of 346 facilities per year, EPA would meet its goal with several years to spare.  How has EPA managed to significantly increase the pace of cleanup at RCRA 2020 facilities over the past few years? 
                                                                     

The Marcellus and Utica Shale Natural Gas Play - What are the Issues?   

Marcellus Shale IsopachApproximately 400 to 450 million years ago, organic-rich muds began to accumulate in deep anaerobic ocean basins that covered much of North America.  These organic-rich deposits, including the Marcellus and Utica Shales of Ohio, Pennsylvania, New York, Virginia, Maryland, and West Virginia are rapidly becoming the largest natural gas play in North America.  This multi-part series will look at the potential and associated environmental issues that surround this important new energy source.


Update on EPA's Re-Evaluation of Hexavalent Chromium Risk         

Since 2008, EPA has been re-evaluating its 20-year old drinking water standard for total chromium, with respect to the carcinogenicity of orally ingested hexavalent chromium (chromium-6).  Following the September 2010 draft risk assessment, industry requested (through the American Chemistry Council) that EPA conduct a high-level review of the draft risk assessment through a panel established by the agency’s National Academy of Sciences or Science Advisory Board.  On April 12, 2011 (76 FR 20349), EPA denied industry’s request and stated that it had scheduled a lower-level review panel meeting, to be overseen by an outside agency contractor.  Once finalized, EPA’s risk assessment will likely drive new strict regulatory requirements, including drinking water standards for chromium-6 and possibly new air toxics rules for chromium and steel pickling industries.


Massachusetts Releases Draft Vapor Intrusion Guidance 

From the beginning, the Massachusetts Department of Environmental Protection (MA DEP) has been a leader on the vapor intrusion front.  Recent revision to the MA DEP draft vapor intrusion (VI) guidance provides an interesting view on current thinking in this rapidly-evolving field, as well as some intriguing insights on what to expect from US EPA’s final guidance, anticipated in 2012.

Ohio EPA Reorganization Implemented

Effective April 18, 2011, the Ohio EPA implemented its restructuring of the Division of Solid and Infectious Waste Management (DSIWM), the Division of Hazardous Waste Management (DHWM), and the Division of Emergency and Remedial Response (DERR).  Under this organizational plan, the cleanup-related aspects of DHWM will become part of the DERR under a yet to be decided name.  This division, to be headed by Cindy Hafner, will focus on environmental assessment, cleanup, and revitalization across multiple regulatory programs.  The remaining primarily permitting, compliance, and enforcement-related aspects of the former DHWM and the DSIWM have been merged into the new Division of Materials and Waste Management (DMWM) under the direction of Pam Allen.  Expect some growing pains. New organizational charts are available now.
