The Passing of a Friend and Colleague   

On August 6, 2011 Harold Richard O'Connell, a friend, colleague, and 20-plus year supervisor at the Ohio EPA, died, after finishing a 10K race.  I knew Harold from our college days together and was lucky enough to have worked with him on numerous projects through the years. He spoke at our most recent Corrective Action training course, where he unsuccessfully tried to talk me into the latest running craze - barefoot running. In the consulting role, I spent most of our recent time together sitting "across the table" from Harold.  Despite our occasional professional differences of opinion, he had a way of making the distance across the table seem insignificant. When you worked with Harold, you knew what he expected and why he expected it.  I never heard Harold say a bad thing about anybody.  We could all learn a lot from how Harold lived both his professional and private life.  I'm not alone in saying that I'll miss Harold.

CERCLA's Comprehensive Five-Year Review Process - Will it reopen your remedy?     

The Five-Year Review Process is the responsibility of the EPA, not the regulated community.  It's EPA's mechanism, as provided under CERCLA Section 121(c), to periodically assess its remedy selection process in light of the current understanding of how to assess and protect human health and the environment. Don't expect it to be a simple review of the remedy as defined in the ROD.  Rather, think of it (and prepare for it) as another bite at the apple. 
 
 

Subtitle C Exemption of Oil and Gas Exploration and Production Waste - A Review       

Certain oil and gas exploration and production (E&P) wastes are exempt from regulation as hazardous wastes under Subtitle C of RCRA.  We believe it's useful to revisit this significant exemption given the recent exploration and production  activity focused around the Marcellus shale gas play, the need for disposal of large volumes of flowback water associated with fracking of the source rock, and the current push for EPA to reconsider  the exemption of oil and gas E&P waste.

 

California sets Public Health Goal for Hexavalent Chromium

The State of California has set a public health goal (PHG) of 0.02 parts per billion (ppb) for hexavalent chromium (Cr6), the first drinking water standard for the metal in the United States.  The move by California is prompting calls for EPA to accelerate their pursuit of a national MCL for Cr6.
 
                                            

Moving Closer Toward Consensus-Based GSR Guidance 

Until recently, there has been some uncertainty and inconsistency with respect to incorporating green and sustainable remediation (GSR) principles and practices into cleanup projects because of the lack of consensus-based guidance.  Recent and upcoming publications by the Sustainable Remediation Forum (SURF) and the Interstate Technology and Regulatory Council (ITRC) provide key resources for performing GSR evaluations and implementing GSR activities throughout all phases of the cleanup.
 
 

Background VOCs in Residential Indoor Air

EPA's Office of Solid Waste and Emergency Response (OSWER)  recently released a report that will be of interest to the Vapor Intrusion (VI) community.  The report reviews data from investigations  that measured volatile organic compounds (VOCs) in indoor air in thousands of North American residences, and will help figure out which chemicals came from underground sources and which ones didn't.
